1. Purpose and Scope

This Agreement comprehensively regulates all policies, procedures, and commitments regarding the processing of your personal data within the scope of services provided by EQLEM YAZILIM. Every individual or legal entity registering for, accessing, or in any way using the Platform or Application is deemed to have accepted the provisions of this Agreement. Our Company protects the privacy of your personal data in full compliance with the Law on Protection of Personal Data No. 6698 (KVKK) and international data protection standards.

1.1. Binding Nature of the Agreement

This Agreement has been prepared to establish an environment of trust regarding data security between our Company and its users. By continuing to use the Platform, you agree to comply with the specified data protection rules and responsibilities. In the event of non-compliance, EQLEM YAZILIM reserves the right to suspend or terminate services, or completely close your account.

1.2. Legal and Legitimate Use

As users, you commit to use our Application and Platforms only for legal and legitimate purposes. It is strictly forbidden to use our systems for money laundering, tax evasion, or other illegal activities.

2. Collected Personal Data and Categories

Specific data is collected in compliance with the KVKK to deliver our services, improve your experience, and fulfill our legal obligations.

• Identity Information: Basic details such as name, surname, and specifically Turkish Identity Number (T.C.) or Tax Identity Number required for statutory procedures such as e-transformation (e-invoice).
• Contact Information: Required data for communication such as email address, phone number, work or home address.
• Financial Information: Bank, invoice, and payment details processed during payment, billing, or current account transactions performed through the Platform.
• Usage and Technical Data: IP address, session logs, browser type, and interaction data collected through cookies.

3. Purposes of Data Processing

Your personal data is collected and processed for the following explicitly defined legitimate purposes:

• Service Delivery: Account creation, integrating e-transformation processes (e-invoice, etc.), and executing the primary features of the platform (ERP, current accounts, stock, etc.).
• User Support: Responding rapidly to your technical requests and collecting feedback.
• Security and Performance: Preventing unauthorized access, fraud detection, and monitoring platform performance.
• Compliance with Legal Obligations: Ensuring compliance with tax and accounting legislation, and responding to audit processes of authorized public institutions.

4. Methods of Data Collection and Legal Basis

Your personal data is collected through manual (registration forms, support tickets, surveys, etc.) and automatic (cookies, web beacons, log entries) methods.

Your data is processed based on the legal grounds specified in the KVKK: "Explicit Consent, Performance of a Contract, Legal Obligation, and Legitimate Interest".

4.1. Data Entered by the User and Recourse Liability

If the User uploads or records any personal data regarding their own customers, employees, or other third parties to the Platform or Application, the User declares and undertakes that they have fully obtained all necessary KVKK explicit consents and fulfilled all disclosure obligations required for the collection, transfer, and processing of such data on the Platform. Any administrative, criminal, and legal liability arising from the unauthorized or unlawful entry of such third-party data onto the system belongs solely to the User (Buyer); any fines, damages, or costs reflecting back to EQLEM YAZILIM for this reason shall be recourse to the User (Buyer) along with their legal interest. The User is obligated to immediately compensate for all indirect and direct damages suffered by EQLEM YAZILIM in such cases.

5. Data Security and Retention Period

Your data is protected in the cloud-based infrastructure of our platforms using encryption (SSL/TLS) technologies with the highest security standards, access controls, and periodic data backup systems.

Your financial data and transaction details subject to invoicing are stored for the statutory periods of limitation (generally 10 years) in accordance with relevant tax and procedure laws (e.g., Tax Procedure Law). Usage data may be stored in anonymized form for analytical purposes. At the end of the retention period, data is deleted, destroyed, or anonymized in accordance with KVKK procedures.

5.1. Third-Party Infrastructure Liability Limit: EQLEM YAZILIM utilizes global standard cloud infrastructure providers (e.g., AWS, Bunny.net, etc.) for hosting and processing data. EQLEM YAZILIM cannot be held directly responsible for global data interruptions, infrastructure failures, cyber attacks, or data leaks originating from these third-party infrastructures that are beyond the reasonable control of EQLEM YAZILIM. The Company's liability in such cases is limited to pursuing legal rights against the respective providers and immediately implementing necessary technical and administrative measures.

6. Sharing Data with Third Parties

Your data may be shared with third parties within the framework of legal obligations (requests from courts and public institutions), service delivery (banks, cloud service providers, e-transformation partners), and with the explicit consent of the user. Confidentiality agreements complying with KVKK standards are established for all sharing activities.

7. User Rights (KVKK Article 11)

As a user, you have the rights to learn whether your personal data is processed, to request correction/deletion (right to be forgotten), to object to processing, and to request data portability. 8. Amendments and Legal Framework

EQLEM YAZILIM reserves the right to unilaterally update this Agreement at any time in accordance with legal regulations, technical requirements, and commercial policies. Amendments are deemed effective from the moment they are announced or published on the Platform or our website. By continuing to use the Platform or Application after the publication of amendments, the User is deemed to have implicitly accepted the updated agreement provisions.
